These Terms and Conditions (“Terms”) govern your use of Monique, a virtual support assistant powered by generative artificial intelligence made available by Moneris Solutions Corporation (“Moneris” or “we”). By using Monique, you agree to these Terms, as may be updated from time to time.
While we strive to provide accurate information through Monique, the responses generated by Monique (the “Responses”) may be inaccurate, outdated, misleading, and incomplete. You are solely responsible for verifying the accuracy of Responses before relying on them. Moneris, its suppliers (including Ada Support Inc.), and their respective affiliates and sub-processors are not liable for any loss, damage, or harm resulting from your reliance on the Responses or otherwise in relation to your use of Monique.
“Personal Information” means information about an identifiable individual, but does not include the name, title or business address or telephone number of an employee of an organization.
(a) Moneris, its suppliers, and respective sub-processors/sub-contractors may use the Personal Information you provide through your use of Monique to make Monique and related functionalities available to you. Moneris may store, review, and analyze your chat logs and related metadata to improve Monique and related services, to identify you to better assist you, to ensure quality assurance, and to comply with legal obligations. You agree that this information may be accessed and stored in Canada and outside of Canada. If you reside in Quebec, you consent to its transfer outside Quebec. Use of your Personal Information is also governed by our Privacy Statement, which may be updated from time to time: https://www.moneris.com/en/legal/privacy-statement.
(b) You agree that Ada Support Inc. may create anonymized information based on the data they receive through your use of Monique. This anonymized information will not include confidential or personal information and will not be used to train any text-generating models. It may be used to improve their services.
You agree that in using Monique, you will
(a) not input or send any sensitive Personal Information, Payment Card Information (PCI), confidential, or otherwise sensitive information into Monique (however, to provide certain services and better assist you, for example, to facilitate your transfer to our support or sales teams, you may be prompted by Monique to provide certain business information such as your name, business name, phone number, and Merchant ID);
(b) not use Monique for any purpose other than for its intended function to provide customer support and answer your questions related to Moneris’ products and services, nor use Monique in a manner that is abusive, infringes the rights of Moneris or any third party, or in any manner that is otherwise unlawful; and
(c) not use Monique in a manner that would put Moneris out of compliance with Ada Support Inc’s Acceptable Use Policy (https://www.ada.cx/legal/acceptable-use-policy).
