Code of Conduct for the Payment Card Industry in Canada

The Code of Conduct for the Payment Card Industry in Canada (the “Code”) was first introduced in May 2010 by the Department of Finance of the Canadian Government.

A subsequent revision of the Code was released in May 2015.

The latest Code of Conduct is effective October 2024 with some technical changes taking effect in April 2025.

What is the Code of Conduct for the Payment Card Industry in Canada?

Introduced in April 2010 by the Financial Consumer Agency of Canada (“FCAC”), the Code of Conduct for the Payment Card Industry in Canada is an operating standard aimed at promoting fair business practices in payment card issuing and merchant payment services.

The Code of Conduct for the Payment Card Industry in Canada applies to all payment card industry participants, including: the payment card brands (also referred to as the Payment Card Network Operators), payment card issuers, acquirers, and payment processors with the purpose of:

  • Ensuring merchant cost of acceptance transparency and pricing flexibility; and,
  • Protecting merchant choice over their payment options.

What are merchants’ rights under the Code of Conduct?

The Code of Conduct for the Payment Card Industry in Canada establishes merchant rights pertaining to card acceptance and their relationship with acquirers, such as Moneris. These rights include:

  • To receive statements that are clear, concise and complete;
  • To receive a standardized merchant agreement which includes a summary of key elements, cost-of-acceptance and fees;
  • To receive notice of changes to cost-of-acceptance that is clear, concise and complete;
  • The right to cancel without penalty following changes to cost-of-acceptance, and to provide notice of non-renewal;
  • The right to offer discounts across different methods of payment;
  • The choice over payment card acceptance methods and products; and
  • Access to a clear complaint and dispute resolution process.

What is not covered in the Code of Conduct for the Payment Card Industry in Canada?

The Code of Conduct for the Payment Card Industry in Canada establishes merchant rights pertaining to card acceptance and their relationship with acquirers, such as Moneris. The Code of Conduct does not cover the following:

  • A Pre-determined Fee Schedule
  • Non-domestic Fee changes
  • Other PCNO Fees
  • Other Acquirer/Processor Fee

When will Moneris notify merchants of changes or new cost-of-acceptance related to their payment card processing?

Moneris is committed to provide merchants with adequate advance notice and in accordance with the Code of Conduct for the Payment Card Industry in Canada. Notice will be issued for applicable fee increases and the introduction of a new fees related to payment card transactions, and reduction in applicable interchange not passed on. The notice period allows merchants the time to assess the financial impact of the change.

Following notice, a merchant may choose to exit their contracts with Moneris without penalty and in accordance with their merchant agreement and the Code of Conduct for the Payment Card Industry in Canada.
