General Eligibility Criteria and Terms
The promotional offer described below (“Offer”) is available from February 17, 2020 to March 31, 2021 (the “Offer Period”) and is available only to merchants and merchant locations located in the Province of Quebec, who do not currently have an agreement for payment processing services with Moneris Solutions Corporation (“Moneris”), and that enter into Visa®, Mastercard®, Discover® and Interac® processing agreements with Moneris and rent or buy terminal(s) from Moneris during the Offer Period. Offer is limited to one (1) per merchant. Moneris is under no obligation to approve a merchant for any services and reserves the right to determine a qualified merchant in accordance with its credit adjudication and other policies and procedures. Following satisfactory internal Moneris approval, merchants will be required to agree to, and agree to be bound by, the terms and conditions under the merchant and/or gift card processing agreement(s) and/or other agreement(s) with Moneris (individually, the “Agreement” and collectively, the “Agreements”).
The Offer does not apply to Moneris PAYD® and PAYD Pro® products. Merchants (i) currently participating in a merchant program for franchisees, trade associations, member associations or other buying groups; (ii) that rent more than ten (10) terminals from Moneris; or (iii) that have processed an aggregate Visa® and Mastercard® transaction volume of $2,500,000 CAD or greater in the preceding three months, are in each case not eligible for the Offer.
The Offer is subject to change, withdrawal or cancellation at any time and is not valid or combinable with any other offer for Moneris processing services. If any of the applicable Agreements is terminated prior to the expiry of its term, Moneris may require the merchant to pay, and the merchant will pay to Moneris, the amount (or value) of the Offer it received. The merchant remains responsible for all other fees and payments in accordance with their Agreement, including applicable restocking fees.
Offer Details
This Offer consists of the following components. Depending on the Moneris services the merchant receives and its qualification in accordance with these terms and conditions, the merchant may not be eligible to receive each component.
1. Waiver of Terminal Rental Fee
Moneris will waive the terminal rental fee, as set out in the Agreement, on up to ten (10) merchant point-of-sale payment terminal rented by the merchant, up to a maximum value of $250 per month for the first two (2) full months of rental. To receive the full value of this offer, the merchant must rent the applicable terminal for at least two (2) months. Merchants who do not rent a terminal from Moneris are not eligible for this component of the Offer.
2. 90-day Satisfaction Guarantee
The 90-day satisfaction guarantee is limited to a waiver of the cancellation, deactivation, or restocking fee if the merchant cancels any of the Agreements within 90 days from the date of the Agreement. All other fees, charges and terms and conditions in the Agreements apply.
3. Meet and Beat Transaction Fees
Prior to entering into an Agreement, eligible merchants must provide Moneris with its Mastercard®, Visa® and Interac® merchant processing statements for the last three (3) full consecutive months preceding their application to Moneris. The rate comparison for Moneris’ offer will be based on the processing rates for Mastercard®, Visa® and Interac® transactions as set out in the processing statements provided, and subject to parameters and comparators as determined by Moneris. Rates comparison excludes any one-time or activation fees, service fees, terminal rental fees or other event-driven fees. Moneris will offer the eligible merchant a pricing proposal for Mastercard®, Visa® and Interac® rates based on the foregoing analysis, which will form part of the Agreement if agreed to by the merchant. The comparison is valid as of the date statements from the existing acquirer are provided by the merchant as compared to the offered Moneris rates.
4. Waiver of Deposit Consolidation Fee
Moneris will waive the merchant’s deposit consolidation fee, as set out in the Agreement for up to the first twelve (12) full months of service. To receive the full value of this offer, the merchant must receive processing services from Moneris for at least twelve (12) months.
5. Gift Card Discount Offer
Merchants who meet the criteria set out in this offer are eligible to receive a discount of fifty percent (50%) off of the standard list fees (excluding taxes) of the first order of gift cards made with Moneris pursuant to their Agreement, provided that (i) such order is made within the first thirty (30) days of the effective date of the Agreement; and (ii) such order is for three hundred (300) or more gift cards.
