Who Can Participate?

To qualify, you must:

1. Be a new or existing Moneris customer in Canada.
2. Have or sign up for a Moneris Merchant Agreement to process credit/debit card payments.
3. Sign up for a Moneris Online Business Plan through the offer URL.

Exceptions

You can't participate if:

1. You're part of franchisee, trade association, or member associations or other buying groups
2. You've processed more than $2,500,000 CAD in Visa and Mastercard transactions in the last three months.

Using Website Creation Service

Responsibilities and Permissions: If you choose to use the Website Creation Service, you will need to provide us with clear directions and instructions for your website's development. Additionally, we may request permission to edit and make changes to your website during its development. You are solely responsible for your website, including the review and approval of any changes, content, or edits we suggest. Should you decide to stop using the Website Creation Services, it is your responsibility to revoke any editorial permissions you have granted us.

Service Limitations: We reserve the right to stop offering this service at any time, without prior notice. The service is provided "as is" and without warranties of any kind, whether express or implied. In the event of any issues, our liability is limited to the fees you've paid for the Website Development Service.

Changes and Restrictions

We reserve the right to change or end these offers anytime. These offers can't be combined with other Moneris offers or applied to past purchases. Offer is limited to one per merchant.

Automatic Renewal and Cancellation

Your Moneris Online Business Plan will automatically renew at the end of the 1- year promotional period, and regular pricing will apply, unless you cancel within ten (10) days before the renewal date.

To cancel your Moneris Online Business Plan, call us at 1-866-271-9055 at least 10 days before the end of the promotional period.

Liability and Dispute Resolution

The Website Development Service is provided to the merchant on an “as is” and “as available” basis. All other representations or warranties, express or implied, including any warranties of merchantability or as to correctness, quality, accuracy or reliability or as to fitness for a particular purpose are specifically excluded and disclaimed. The liability of Moneris to the merchant arising out of, or in any way related to, the Website Development Service, will, in the aggregate, be limited to actual, direct and general monetary damages in an amount not to exceed the total fees, if any, paid by the merchant for the Website Development Service to Moneris. This limitation of liability applies regardless of the form in which any legal or equitable action may be brought against Moneris, whether under contract, tort (including negligence) or otherwise, and the foregoing will constitute the merchant’s exclusive remedy.

Except as otherwise provided herein, Moneris, its officers, directors, employees, shareholders, promotion agencies, agents, successors, assigns and service providers will not be liable for any direct, indirect, incidental, special or consequential damages arising out of the Offer, even if advised of the possibility of such damages. By participating in the Offer, the merchant waives any and all rights to bring any claim or action related to such matters in any forum beyond one (1) year after the first occurrence of the incident upon which the claim or action is based. The merchant agrees that any and all disputes, claims and causes of action arising out of or connected with the Offer, shall be resolved individually, without resort to any form of class action.

By participating in the Offer, the merchant agrees to release and hold harmless Moneris and each of its parents, subsidiary, affiliate and related companies, and its and their respective officers, directors, employees and agents, from and against any losses, damages, rights, claim or cause of action of any kind arising or resulting, in whole or in part, directly or indirectly, out of participation in the Offer or from acceptance, possession, use or misuse of any item given in connection with the Offer.
